The freedom of information Act ensures that all information, subject to certain exceptions will be available to the public. This applies to individuals who apply to see information about themselves as well as ‘third party access’. Information will not be disclosed if it will breach the principles of data protection. It should now be easier for people to access information in their own records and should make it more difficult for information to be improperly used.
As a foster carer I will receive information about children and young people in my care, which may be confidential. I will also be recording and storing information, which come to me while the children are placed in my home. Apart from any legal requirement I have a ‘common law duty of confidence’, a responsibility to ensure that this information is kept secure, preferably by using a physical barrier such as a locked filing cabinet.
