Case-R. v. Macooh [1993] 2 S.C.R. 802 Supreme Court of Canada Pg. 192 • An officer saw Macooh drive through a stop sign (summary offence) • Officer turned on his cruiser’s emergency signals and followed suspect • Macooh accelerated and drove through 2 more stop signs • ran in the back door of an apartment building • officered yelled at him to stop, he followed him to apartment and identified himself as an RCMP officer. • Suspect did not answer, so officer entered apartment and found Macooh in bed • Officer advise Macooh that he was under arrest for failing to stop for police officer • Accused appeared to be impaired and resisted the officer. • He was arrested and charged w/ impaired driving, failing to stop for peace officer, failing to provide breath sample, and assaulting a peace officer w/ intent to resist arrest • At trial, provincial court judge ruled that the officer’s entry into dwelling-house while in hot pursuit of Macooh for a provincial offence was unlawful.
