In short there are loopholes in the current policy which allow people to avoid the current laws and make it difficult to prove that an employer has indeed committed a violation With both of these laws, it was up to the women to prove of the discrimination fell upon the women who had been discriminated against. This made winning these cases difficult as one had to prove that the pay differences were not due to any other factors, and that the work performed by the men and women were equal. This standard changed with the Civil Rights Act of 1991, when the burden of proof was shifted to the employers. Furthermore, there are a great number of pay discrimination cases waiting to be heard, and very few cases can be heard each year. This has created a very extensive waiting list for pay discrimination cases. Therefore, justice is very slow in these cases, and many victims are turned off by the long wait for the case to be heard. Although there have been several laws passed making pay discrimination illegal, the reality is that these laws have been difficult to enforce. Though the difficulty has varied from the actual wording of the law to the wait for the court cases, the end result has been the same; the pay equity laws have not been adequately enforced, and this is why there is a wage gap almost thirty years after the Equal Pay Act was passed. Therefore, further change is needed to ensure equal pay for equal work for men and women. Women have made enormous progress in the workforce since the Equal Pay Act, but the stubborn fact remains that almost four decades later the basic goal of the act has not been realized.
