...obvious the Roman constitution in practice didn’t contain the necessary checks and balances needed to prevent tyranny. Yet the idea of mixed constitution was passed down for two millennia and found itself into the United States Constitution in 1789. Tyranny is what the framers was the most afraid of and they didn’t want it. James Madison was among them who were scared that one branch might become stronger then another and take control. That is why he wrote the Federalist papers number forty seven. They say basically they didn’t want to make just three separate powers, they wanted to make three overlapping powers and that is what they did. This is so each branch could keep the others from becoming to big. The legislative branch is separated into two separate houses so it can check itself also and to give fair representation to the states. It can over ride a veto, impeach anyone from the executive branch, any supreme judge, or members of supreme court, also they control the judicial branches budget. The executive branch is were the president is placed. Every bill passed by congress must go through the president, and the president appoints all supreme judges. The judicial branch has the power of judicial review and can review any member from each of the opposing branches if it’s called for. Aristotle believed in a government of the one the few and the many. He knew that in order to do this you must prevent tyranny and to prevent tyranny you must have check and balances.
