Crime and Causation

Another test for causation not mentioned earlier is the ‘but for’ test. If it is true, that ‘but for’ the actions of the accused, the victim would not have suffered the same consequences, then causation applies. Whether the chain of causation is valid or not, factors such as assumption of liability by a third party or acts of God are held to break the chain. On the flip side of this, factors such as innocent acts of other parties, omission of the victim to seek treatment for injuries, any unusual sensitivity of the victim to a particular injury are usually taken to not break the chain of causation (Boone 2003).
