The fair use doctrine is a body of law and court decisions, which provide for limitations and exceptions to copyright protection in the United States. In a case where the fair use defense is asserted, the defendant has conceded that an infringement of the copyright laws has taken place but that the action falls within an excepted category of activities. The factors to be examined to determine if the fair use defense is appropriate include:
