Lucy versus Zehmer Case
... FACTS: On the night before Christmas Zehmer and Lucy where having a drinking at a restaurant. After they had talked and drank for a while Lucy asked whether he owned the Ferguson farm. Zehmer replied that he had not sold it yet and Lucy than said that here wouldn’t buy it for $50, 000. Lucy claimed he had $50,000 in cash. Zehmer wrote on the back of a piece of paper that “I do hereby agree to sell to the Ferguson Farm for $50,000 complete.
