“Slight or nonexistent penalties for vehicular homicide allow people literally to get away with murder.” This is Bonnie Steinbock’s thesis statement for her article, with which I completely agree, Drunk Driving. Her thesis states that with lack of consequences to drinking and driving people are killing with no repercussions. The penalties are definitely not high enough to deter people from drinking and driving. Steinbock focuses on three main points throughout her article: Malice and Murder, Intoxication and Culpability, and Deterrence. Steinbock first looks at Malice and Murder. She focuses more specifically on the intent of drunk drivers (“the mens rea for murder”). “Homicide by extensive risk taking” is exactly what the court systems have labeled killings by drunk drivers. People who frequently drink know the possible risks involved with their behavior because of their previous experiences with drinking. They are fully aware of their actions or of what they may do because of past incidences. She says that plea bargaining and loopholes are an easy way for people to get out of these murder charges for drunk driving. I agree with Steinbock completely. The accused plead guilty to their charges.
