Ways and means to retain some control over a trust Trusts require settlers to relinquish control over their hard-earned assets but not always. Nadya Renwich runs though a number of options available to those who want some measure of control. THE SCEPTICISM and possible hostility, with which the trust concept is viewed, particularly in civil law jurisdictions, is in some ways understandable. Not only is a settler transferring legal ownership in assets belonging to him to trustees, but this transfer of legal title is usually accompanied by a loss of enjoyment of the trust property which he may have spent a lifetime accumulating. What options, then are open to a settlor who genuinely wishes to engage in estate and tax planning but either needs access to the funds being gifted into trust for day-to-day living expenses or wishes to have a say in the trust property?
