Magistrates essay
Describe the role of magistrates in both civil and criminal cases.
There are around 700 Magistrates Courts around the UK having both criminal and civil jurisdiction. All cases begin in the Magistrates Court and are usually heard by a bench of 3 magistrates who are none qualified. ... There are approximately 30,000 lay magistrates who hear 95% of all cases. The magistrates are unpaid; however their travel and meals are paid for. ... Both types of Magistrates sit between 26 and 35 half days per year.
The magistrates have several responsibilities in criminal cases, firstly they decide whether bail can be granted or not, they conduct plea before venue and mode of trial hearings, hear summary cases and decide on a verdict, pass indictable cases to the Crown, if there is a guilty plea they decide what sentence would be appropriate, they can issue warrants for search and arrest and some qualified magistrates can conduct youth cases, which involve children at the age of 10- 17.
