The maintenance of order in Chinese villages is harsh and tyrannical in comparison with today~{!/~}s standards of judicial maintenance and order. This paper will provide conflicting views of modern society versus the imperialistic judicial strong hold of Chinese rule. Issues such as representation, rights of the accused, absence of the jury and the judge holding the power of executioner are all issues that contradict the philosophy of modern justice. The Celebrated Cases of Judge Dee is the perfect example of the Eastern Asian justice systems. With many similarities to modern judicial systems such as holding an actual tribunal, conducting investigations and interrogations are some of the similarities amongst the systems. This is the fork in the road that modern and ancient split, the power held by the judge is one mandated by the empire. Modern judicial delegates are held under microscopic view of the public and constitutional constraints. Police interrogation is a perfect example of old versus modern practice of judicial power. Modern judges never have the opportunity to intervene with the process, it is left to professionals. Even though the questioned still has rights as to his treatment. The individual 2 interrogating is not permitted to use any forceful means to extract information. The accused also has the right to refuse to speak without proper representation in fear of self incrimination. In the time period that this book takes place the judicial advocate has the consent to use any means necessary to withdraw information of the accused.
