8- Do you think the EU Commission had a strong case in its attemps to wring concessions from the merger with Mc Donnell Douglas?
The European Commission has voted in favor of the merger between the two aeronautic constructors: Boeing and Mc Donnel Douglas. This has been announced by Karel Van Miert, the EU competitor commissioner. Boeing has made some important concessions in order to prevent the commission from declaring this merger illegal.
This case has been the first time when a European institution pocks its nose in a US business transaction. First, Ill review the difficuties that the commission had in this case. Then , Ill descibe what are the concessions that Boeing made during the merger process. ...
The position of the EU commission in this case was not easy to maintain. In fact, the commission had the hard mission to judge the merger of two foreign companies. In December 1996, Boeing announces it would merger its old competitor: Mc Donnell Douglas. ... To judge whether the merger was legal or not, two authorities were asked to investigate: the Federal Trade Commission, a US commission and the Competition Commission of the European Union. ... The commission which had no real objections to the merger, started to have some and changed its mind.
Another difficulty for the EU commission was to be shared between to positions:
-Protecting the european economics interests by refusing to allow the merger.
