Housing law questions 5) Protection from Eviction: To what extent does the law protect a tenant from eviction? Everyone living in rented accommodation, whether it be private or public housing such as council housing have rights protected by law ranging from full security of tenure to the landlord giving notice and getting a court eviction order. The amount of protection varies depending on the type of rental agreement a person has with his landlord and whether or not it is lease/tenancy or license, a tenancy having more protection from the law. It is also worth noting that a landlord cannot forcefully evict a tenant, only bailiffs can do that if sanctioned by the courts Secure tenancy If a tenant has security of tenure, a landlord could only seek eviction if certain criteria are met as stated in statute, but even then it is up to the judge if he grants possession to the landlord or not Assured tenancy People with an assured tenancy can only be evicted by a court order.
