Hate speech is another form of our constitutionally protected right to free speech and it would be unconstitutional to implement bans against such speech on college campuses. Not only is banning hate speech unconstitutional, but it will also have adverse effects. With such bans on speech in the college campus setting, many students will keep their socially unaccepted ideas underground where they will linger until a possible release of their hateful expression in a violent manner. Some hate speech users will likely act like an evolving virus and change their verbal skills to comply with the new living conditions while maintaining their same message. Such laws banning hate speech would be very difficult to enforce, and to enforce fairly. Many discriminatory effects would take place as a result of banning hate speech.
A distinction between hate speech and hate action needs to be made. Hate actions involve violence and hate expressed physically on other people. Hate actions are illegal and have no place in our society. Hate speech is a form of speech that expresses dislike for a particular type or group of people but in a non-physical way. ... Although people may dislike the presents of hate speech, they need to recognize it as a non-violent form of communication
