Rape is a heinous crime to commit and people who rape should be punished thoroughly and to the full extent of the law. ... Racial bias is an issue that dwindles about in many aspects of life; the legal system is not to be forgotten. When making their decisions, juries are not immune to racial biases in rape cases and decisions are oftentimes made not based on real evidence but rather on presupposed notions in the minds of jurors as to the nature of African-American men. ... The man is then “tried” by a jury of Ku Klux Klan members, and lynched. ... Almost one hundred years later, some Americans maintain that frame of mind and make decisions of guilt as well as sentencing accordingly.
A study performed at North Carolina State University by Kitty Klein and Blanche Creech found that black men were at a great disadvantage when being tried for rape:
Years of recommended imprisonment indicated greater severity toward the Black assailant of a White woman. The results suggest that bias in favor of White victims occurs both in the assessment of pretrial probabilities and perception of evidence. ... In order to conduct this experiment, the testers showed the subjects a matrix of sixteen racial combinations for which they had to decide the probability that defendant was in fact guilty.
