Anti-discrimination legislation can be found in both Commonwealth and State acts. The Racial Discrimination Act 1975, the Sex Discrimination Act 1984 and the Disability Discrimination Act 1992 are all Commonwealth Acts that forbid discrimination. Anti-Discrimination Act 1991 (Qld) prohibits discrimination within Queensland.
Discrimination can be defined as treating a person differently than others without sound cause (Carvan, Gooley & McRae 1999, pp. ... Discrimination may occur directly or indirectly. If a person is refused employment due to gender then this is direct discrimination: Wardley v Ansett Transport Industries (1984). Indirect discrimination is when the purpose of conduct is not discriminatory, but the effect is to discriminate on a prohibited ground: Leves v Haines (1986).
