Democracy requires that the government protect individual rights. The freedom of press, speech, religion, petition, and assembly protected by our First Amendment is essential to the process of holding elected representatives accountable to the power of the people. In addition, the citizens must be protected against a corrupt government that would rob them of their life, liberty or property through an unfair or arbitrary judicial process. The Bill of Rights provides a system of justice that protects the rights of those who are accused of crimes against society. With the Sixth Amendment guarantee of public trial by a jury of fellow citizens, the people are given the power to monitor and participate in the justice system. To be truly democratic, all power must reside with the citizens and all citizens must have power. In a representative democracy, this power is expressed through voting for those who will carry out the functions of government.
