Due to the fact that the practice of discriminating based on age is so prevalent there have been laws and regulations put in place to protect employees from being victimized. The Age Discrimination Act of 1967 (ADEA) protects individuals who are 40 years of age or older from employment discrimination based on age. ... Under the ADEA, an employee’s terms, conditions, or privileges can not be discriminated because of his/her age. ... Laws also protect people from being retaliated against for opposing employment practices that discriminate, filing age discrimination charges, testifying, or participating in a discrimination hearing or investigation. Age preferences, limitations, or specifications cannot be included in job notices or advertisements according to the ADEA. It is not illegal to ask an applicants age, but these requests are watched closely so that this information is not solely used to make decisions when hiring employees.
