An article written by Tom Curry the national affairs writer for MSNBC, answers the question, what are the possible outcomes of this battle, he wrote “If the Supreme court ruled same sex marriage is a fundamental constitutional right, then same sex marriages would be legal in every state despite what any state law or state constitution said on the matter. But if on the other hand Congress and State legislatures passed and ratified the Musgrave amendment, then same sex marriage would not be legal anywhere in the United States, despite what state courts or state law might have previously said.” Curry goes on to point out other possibilities; “Congress and the state legislatures pass and ratify a constitutional amendment that says each state can decide for itself permitting or banning gay marriages as they see fit.
