Explaining and discussing the meanings of the term common law
Question 1 Briefly explain and discuss the meanings of the term “common law”. To answer this question, the term “common law” is used in a number of different ways. Therefore I need to identify and briefly discuss all of the ways in which it is used thus giving the meanings to the term “common law”. There are three that comprise this as follows:- (1) Common law/Civil law In this context, ‘common law’ means legal systems which are based on the English Legal System, in contrast with the Civil Law System which is the foundation of continental legal systems and thus is the basis of the law of most of the other member states the European Union (except the Republic of Ireland).
