In light of Massachusetts decision on gay marriages the remaining States will have to follow with a decision on this controversial issue. States are being put between a rock and a hard place by being given the task of determining whether gay marriages are legal, or calling them civil unions, or just outright banning them. ... The Justices decided that gay marriages would be called civil unions and have the same legal rights as same sexed marriages.
One problem raised in class discussion was that if one State recognizes civil unions, or gay marriages, with the same rights as marriage and another State doesn’t recognize either then which State decision is superior? Massachusetts ruled that gay marriages are allowed while Ohio ruled that it is illegal to have a gay marriage or civil union. Say a gay couple got married in Massachusetts and moved to Ohio what would happen to their marriage?
